Apostille Process: Know How To Authenticate The Documents

published on: 03.09.2024 last updated on: 01.10.2024

The world of international documents can be tricky, especially when you need specific paperwork authenticated for use abroad. This Apostille process, known as obtaining an apostille or certificate of authentication, is essential for verifying public documents like birth or marriage certificates issued in New York State.

Apostille is mainly done for personal documents like birth/marriage/death certificates. Moreover, affidavits and documents like matriculation, diplomas, degrees, and secondary-level certificates are accepted and recognized by the Hague Apostille country list. This is beneficial for those candidates, as it makes it unnecessary to attest documents for every country separately.

What is an apostille?

An apostille is a form of authentication used for official documents that are intended for use in foreign countries. So, if you’re planning to work, study, or conduct business internationally, you might need these documents authenticated.

Examples include personal records such as birth, death, or marriage certificates. The New York State Department of State provides this service, authenticating documents signed by a New York State official or county clerk only. For instance, if you require an authenticated birth certificate, this service becomes invaluable.

Now, what is the difference between an apostille and a certificate of authentication? Both serve similar purposes but are used depending on the country where the document will be presented. An apostille is utilized within member countries of the Hague Convention, while a certificate of authentication is needed for non-member countries.

An Apostille is obtained to transmit public documents issues from one signatory country to another country, where they will produce the document. Thus, the definition of a public document according to the Hague Convention is:

  • Those that originate in a court, public prosecutor, clerk of a court, or process server
  • Administrative documents
  • Official certificates
  • Notarial acts

When is the Hague Apostille used?

An apostille is only used between the states which are members of the Multilateral Hague Convention. A Hague Apostille is required when:

  • Firstly, the country where this particular document was issued is a part of the Apostille Convention;
  • Secondly, the country where the particular document is going to be used is a part of the Apostille Convention;
  • Thirdly, the law of the country where the document was issued thinks of it as a public document;
  • Finally, the country where the document is going to be used needs an Apostille in ogre to recognize it as a foreign public.

What information is required in an Apostille?

As a legal document, there is a prescribed format that the Apostille Certificate follows containing the following information:

  • The country that issued the document
  • Who signed the document
  • The capacity in which the document was signed
  • Details of all the seals on the document
  • Place of issue
  • Date of issue
  • Apostille certificate number
  • Issuing authority
  • Stamp of issuing authority
  • Finally, the signature of the representative of the issuing authority

Getting through the apostille process

You can obtain apostille services via two main methods. Firstly, you can send a mail and submit all necessary documentation through postal services to the NYS Department of State. Secondly, there is a walk-in service. Visit customer service locations in New York City, Albany, or Utica to drop off your documents directly.

So, let’s now see the step-by-step process of obtaining an apostille.

Step 1: Obtain your document

First, get a copy of the document that needs authentication. For vital records (birth, marriage, death), contact the relevant local office or the New York City Marriage Bureau. However, educational documents must come with a certification from the educational institution, verifying it as an official record or true copy, notarized by a notary public.

Step 2: Certification by New York State officials or County Clerks

Before you submit your document for an apostille, ensure it’s certified by a New York State official or the respective County Clerk. Documents like birth, death, and marriage certificates need verification from the issuing local official first. However, remember that exceptions apply to those directly issued by the NYS Department of Health that do not necessitate county clerk certification.

Step 3: Submission and payment

Submit both original documents along with all required certifications to the NYS Department of State. However, be sure to include the necessary fee as per their guidelines to avoid delays. Also, you must follow the latest instructions, as changes in submission forms, particularly regarding credit card information, may affect processing times.

Tips for a smooth apostille process

However, to ensure a smooth apostille process, it’s crucial to verify that your documents are correctly certified by the appropriate authority. Also, for vital records like birth or marriage certificates, make sure they are certified by the relevant state or county official.

Moreover, if the document requires notarization, double-check that it’s properly notarized and, if needed, certified by the County Clerk. Carefully follow the submission guidelines, including payment instructions, and ensure all information is accurate. Incomplete documents or incorrect payments can lead to delays, so it’s important to review everything before submitting to avoid complications.
